Application Name: BlueShifts
By downloading, installing, accessing, or using the BlueShifts mobile application ("BlueShifts," "Application," "we," "our," or "us"), you acknowledge that you have read, understood, and agreed to these Terms of Service and Privacy Policy.
If you do not agree with any portion of these Terms, discontinue use of the Application immediately.
1. Service Overview
BlueShifts is a scheduling, shift-management, overtime-tracking, and earnings organization application intended to assist users with:
- Managing schedules and calendar events
- Tracking off-duty and overtime assignments
- Recording payment and earnings information
- Organizing work locations and addresses
- Monitoring hours worked and shift activity
- Managing work-related planning information
The Application is intended solely as a personal organizational and tracking tool.
BlueShifts is not a payroll service, accounting provider, banking institution, tax preparation platform, or employer management system.
2. User Responsibility
Users are solely responsible for:
- Information entered into the Application
- Accuracy of schedules and earnings records
- Maintaining backups of their information
- Protecting access to their devices
- Compliance with employer policies and applicable laws
BlueShifts does not verify, audit, or validate user-entered information.
3. Privacy & Data Storage
Local Device Storage Only
BlueShifts is designed to store user information exclusively on the user's own device.
All user-entered information, including but not limited to:
- Calendar events
- Shift schedules
- Off-duty assignments
- Overtime records
- Earnings information
- Payment tracking
- Financial summaries
- Addresses and work locations
- Notes and planning information
is stored locally on the user's personal device only.
BlueShifts does not permanently store users' private scheduling information on centralized servers. When synchronization is enabled, encrypted schedule data may be temporarily stored on our servers solely for the purpose of synchronizing data between the user's devices. Such data is deleted from the server after synchronization is completed. BlueShifts may also permanently store limited non-scheduling information, such as the user's selected home state and county, to support App functionality.
BlueShifts does not maintain centralized databases containing users' schedules, addresses, financial records, or work-related information.
4. Financial & Earnings Information
BlueShifts allows users to manually track compensation-related information for personal organizational purposes.
This may include:
- Hourly earnings
- Overtime income
- Off-duty compensation
- Shift totals
- Payment tracking
- Financial estimates
- Earnings summaries
All financial information entered into the Application is stored locally on the user's own device only.
BlueShifts does not access, review, analyze, sell, or share users' financial tracking information.
BlueShifts is not responsible for inaccuracies in calculations, estimates, projections, or user-entered financial records.
Users remain fully responsible for managing and protecting their financial information.
5. Address & Location Information
Users may optionally enter addresses, worksite locations, destination information, or related scheduling details into the Application.
All address and location information entered by users is stored locally on the user's own device only.
BlueShifts does not maintain address databases or location histories on its servers.
BlueShifts does not actively track users' real-time geographic location.
Any device permissions granted by users remain controlled by the operating system settings of the user's device.
6. Limited Technical Information
Certain limited technical information may be temporarily processed by:
- Mobile operating systems
- App marketplaces
- Device backup services
- Crash reporting tools
- Third-party frameworks required for application functionality
This processing may occur solely for purposes such as:
- Application stability
- Error diagnostics
- Device compatibility
- Performance improvements
BlueShifts itself does not intentionally maintain databases containing personally identifiable scheduling, address, or financial information.
7. No Sale of User Data
BlueShifts does not:
- Sell personal information
- Rent user data
- Trade financial records
- Monetize scheduling information
- Use user information for advertising profiling
The Application is not designed for behavioral advertising or commercial surveillance.
8. Third-Party Services
Certain optional Application features may interact with third-party services, APIs, or operating system tools.
BlueShifts is not responsible for:
- Third-party privacy practices
- External platform reliability
- Data handling performed by third parties
- Service interruptions caused by external systems
Users are encouraged to independently review the privacy policies of any third-party services they choose to use.
9. Acceptable Use
You agree not to:
- Reverse engineer the Application
- Decompile or attempt to extract source code
- Modify or create derivative versions of the Application
- Remove trademarks or proprietary notices
- Redistribute or commercially exploit the Application without authorization
- Use the Application in violation of applicable laws or regulations
Unauthorized use may result in suspension or termination of access.
10. Intellectual Property
All Application components, including but not limited to:
- Software
- Interface designs
- Graphics
- Logos
- Branding
- Features
- Layouts
- Trademarks
- Functionality
remain the exclusive property of BlueShifts and its licensors.
No ownership rights are transferred to users through use of the Application.
11. Disclaimer of Warranties
THE BLUESHIFTS APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUESHIFTS DISCLAIMS ALL WARRANTIES INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- DATA ACCURACY
- SYSTEM AVAILABILITY
- SECURITY
- ERROR-FREE OPERATION
BlueShifts does not guarantee uninterrupted operation, synchronization reliability, or compatibility with all devices or operating systems.
Users assume all risks associated with use of the Application.
12. Limitation of Liability
To the fullest extent permitted by applicable law, BlueShifts shall not be liable for:
- Loss of schedules
- Loss of earnings records
- Data corruption
- Device malfunctions
- Service interruptions
- Incorrect calculations
- Lost profits
- Missed assignments
- Indirect or consequential damages arising from use of the Application
Use of the Application is entirely at the user's own risk.
Some jurisdictions do not allow certain limitations of liability; therefore, portions of these limitations may not apply to certain users.
13. Security
BlueShifts is designed to prioritize local-device storage and minimize unnecessary transmission of user information.
However, no software application, device, or electronic system can be guaranteed completely secure.
Users are responsible for:
- Securing their devices
- Maintaining backups
- Managing passwords and device access
- Protecting locally stored information
14. Updates & Modifications
BlueShifts reserves the right to:
- Modify these Terms
- Update Application functionality
- Add or remove features
- Adjust policies at any time without prior notice
Continued use of the Application after changes become effective constitutes acceptance of the revised Terms and Policies.
15. Termination
BlueShifts reserves the right to suspend or terminate access to the Application if users violate these Terms or misuse the Application.
16. Governing Law
These Terms shall be governed and interpreted in accordance with the applicable laws of the jurisdiction in which the Application operator conducts business, without regard to conflict-of-law principles.
17. Google Account and Calendar Integration
BlueShifts’ Google Calendar integration is optional and disabled by default. If you choose to connect a Google Account, BlueShifts requests permission to:
- create and manage a dedicated BlueShifts calendar;
- list your calendars and read events from a calendar you select; and
- identify the connected account and display its email address.
BlueShifts may send the title, notes, location, and start and end times of shifts you choose to publish. It may read the title, description, location, and start and end times of events from a calendar you select. Pay rates, earnings, overtime, mileage, and other financial information are never included in calendar events.
Google user data is used only to provide the Calendar integration, including publishing shifts, displaying events from a shared calendar, and granting view-only access to your BlueShifts calendar when you explicitly request it. It is not sold, used for advertising or profiling, or used to train machine-learning models. Google Calendar requests are made directly between your device and Google. Google user data and authorization tokens are not transmitted to or stored on BlueShifts servers. Calendar data is stored locally on your device, and authorization tokens are stored in your device’s secure system storage.
You may disconnect your Google Account at any time, which revokes BlueShifts’ access and removes stored authorization tokens. You may also revoke access through your Google Account permissions. Uninstalling the application removes locally stored calendar data. Calendars and events created in your Google Account remain under your control and may be deleted through Google Calendar. BlueShifts’ use and transfer of information received from Google APIs complies with the Google API Services User Data Policy, including its Limited Use requirements.
